APPEAL RE-DEVELOPMENT OF 87-93 OAK TREE GARDENS

The meeting of the plans sub-committee of Bromley Council on 30th July resolved to contest the appeal by the developers. The recommendation was as follows:-

 RECOMMENDATION: RESOLVE TO CONTEST APPEAL

Grounds for contesting the Appeal are as follows:

1 The proposal by reason of its layout, bulk and siting in relation to neighbouring residential dwellings constitutes an unsatisfactory and cramped form of backland development, seriously detrimental to the residential amenities which the occupiers of neighbouring properties might reasonable expect to continue to enjoy, thereby contrary to Policies BE1 and H7 of the Unitary Development Plan, Policies 3.5 and 7.4 of the London Plan and the National Planning Policy Framework.

2 The proposal, by reason of its bulk, layout and siting, would constitute an unsatisfactory form of backland development, out of character with the pattern of development, quality and distinctiveness of the surrounding area, thereby detrimental to the visual amenities of the area and contrary to Policies BE1 and H7 of the Unitary Development Plan, Policies 3.5 and 7.4 of the London Plan and the National Planning Policy Framework.

Bromley Council’s Plans Sub-Committee No 2 will be holding a meeting prior to the decision by the Planning Inspectorate to consider any grounds to contest an appeal by the developers (ie grounds for refusal of the planning application) on THURSDAY 30 JULY at 7 00 PM at Bromley Civic Centre, Stockwell Close, Bromley BR1 3UH.  This is a public meeting and you may attend if you wish to do so.  You can view the agenda on the Bromley website – www.bromley.gov.uk

In connection with the following amended planning application, the developers have submitted an appeal to the Planning Inspectorate who will now be making the decision on the application:

Redevelopment of land at rear of Nos. 87-93 Oak Tree Gardens to include demolition of No. 91 and retention of No. 89 with minor alterations to roof and Erection of eight 2 1/2 storey, 4 bedroom houses comprising of two terraces of 3 houses, one pair of semi detached houses and one detached single garage; associated access, parking, landscaping, cycle storage, refuse and recycling provision (Reference: 14/04443/FULL1).

The changes to the plans are described as:
  • removal of the house at No 89
  • increasing the width of the main access
  • adjusting the geometry and turning area
  • additional car parking
  •  additional soft landscaping.

IMPORTANT AMENDMENTS TO THE PROPOSED RE-DEVELOPMENT OF
87-93 OAK TREE GARDENS

Amended plans have now been submitted for the following planning application to Bromley
Council for the re-development of the site occupied by Nos 87, 89, 91 and 93 Oak Tree Gardens at the corner with Portland Road:

Redevelopment of land at rear of Nos. 87-93 Oak Tree Gardens to include demolition of No.
91 and retention of No. 89 with minor alterations to roof and Erection of eight 2 1/2 storey, 4
bedroom houses comprising of two terraces of 3 houses, one pair of semi detached houses
and one detached single garage; associated access, parking, landscaping, cycle storage,
refuse and recycling provision.

The amended plans appear to involve:

  •  The demolition of the house on the site at No 89 in addition to the house at
    No 91;
  •  5 additional car parking spaces;
  •  Changes to drainage which require further clarification.

LERA is continuing to oppose the amended application on the following grounds:

  • The additional pressures on the drainage and sewerage systems which are alreadystruggling to cope with the existing houses on the Estate, and the increased risks of floodingand potential sewerage backup affecting existing houses; and
  • The increased traffic movements on an already busy and potentially dangerous corner.
